These Terms of Service ("Terms") govern your use of Culture Shift Foundation's website, assessment tools, and advisory services. By accessing our website or using our services, you agree to these Terms. If you don't agree, don't use our services.
Culture Shift Foundation is a California 501(c)(3) public charity providing educational content, community assessment, and grant-making activities. Culture Shift Advisors, Inc. is a California C-Corporation providing strategic advisory, implementation support, and technology platform services. These entities operate separately under distinct legal structures. Advisory service fees are charged by Culture Shift Advisors, Inc. — not the nonprofit Foundation.
The Community Impact Assessment is provided as a free educational resource. The AI-generated report is for informational purposes only and does not constitute financial, legal, or tax advice. We make reasonable efforts to ensure accuracy, but community data and organizational landscapes change. Verify specific claims before making investment decisions.
The assessment report is not a client engagement agreement. Receiving a report does not create an advisory relationship with Culture Shift Advisors, Inc. Advisory engagements require a separate written agreement.
Advisory services provided by Culture Shift Advisors, Inc. are governed by individual client engagement agreements, which set forth specific terms, fee structures, deliverables, and confidentiality obligations. In the event of conflict between these Terms and a client engagement agreement, the engagement agreement controls.
We provide strategic advisory and implementation support. We do not provide legal, tax, accounting, investment management, or financial planning advice. Clients are responsible for engaging qualified professionals in those areas. Regulatory and legal requirements vary by state, entity type, and activity — always consult qualified legal counsel before forming entities or structuring charitable activities.
Impact Index™ content, including Impact Multiplier Scores™, Community Transformation Ratings™, and investment analyses, is proprietary to Culture Shift Foundation and Culture Shift Advisors, Inc. Subscribers may access content for personal and internal organizational use. Commercial redistribution, republication, or use of proprietary metrics without written permission is prohibited.
Scores and rankings reflect our methodology at the time of assessment. They are not guarantees of future performance and should not be used as the sole basis for investment decisions.
The BEACON™, COMPASS™, PULSE™, CIPHER™, FLOW™, and RHYTHM™ frameworks, the Impact Multiplier Score™, Community Transformation Rating™, Impact Intelligence Platform™, and all associated methodologies are proprietary intellectual property of Culture Shift Foundation and Culture Shift Advisors, Inc. No license to use these frameworks commercially is granted by these Terms.
Website content, including articles, case studies, and the Community Waterfall Thesis, may be shared with attribution for non-commercial educational purposes. Commercial use requires written permission.
To the maximum extent permitted by applicable law, Culture Shift Foundation and Culture Shift Advisors, Inc. are not liable for indirect, incidental, consequential, or punitive damages arising from your use of our website, assessment tools, or advisory services. Our total liability for any claim arising from our services is limited to fees paid for the specific service giving rise to the claim in the 12 months preceding the claim.
Community investment outcomes depend on many factors outside our control, including local political and economic conditions, implementation partner capacity, market conditions, and community dynamics. Projected impact metrics in assessment reports and client proposals are estimates based on comparable initiatives — they are not guarantees.
These Terms are governed by the laws of the State of California. Any disputes arising under these Terms shall be resolved in the courts of Alameda County, California, or through binding arbitration as set forth in any applicable client engagement agreement.
We may update these Terms as our services evolve. Continued use of our website or services after changes constitutes acceptance. Material changes will be communicated via email to active clients and subscribers.
